    Woollahra Council

    Woollahra Council Tree Preservation Order

    Priority Tree Services provide amongst other tree care services, stump grinding, tree removal and tree pruning (sometimes referred to as tree lopping), as well as consultancy by qualified arborists within the Woollahra Council area. Woollahra Council covers the following suburbs:

    Woollahra Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. The tree is “Dead”
    2. The tree is “Dangerous”, posing an imminent danger to property or life. (Level 5 Arborist report must be provided prior to removal)
    3. Pruning of dead branches from a tree
    4. Selective pruning of branches no larger than 50mm diameter at the nearest branch collar or junction to clear a roof, an external face of a building and powerline clearance.
    5. The seasonal pruning of a fruit tree or tree grown for the purpose of citrus and stone fruit
    6. The tree is of a species that has been declared a noxious plant under the Noxious Weeds Act 1993 as prescribed for Woollahra Local Government area.
    7. The tree is required to be removed by an emergency service or council because it poses or will pose a significant threat to access in an emergency.

    Note:
    Where the exemption provision contained in this clause are applicable for trees greater than 10m in height, written notification to council of intention to carry out tree works is required seven days prior to the work being undertaken.

    The Tree Preservation Order exemption list does not apply to the following:

    1. Any tree with a diameter spread of branches greater than 3m or with a height greater than 5m, irrespective of the spread of branches.
    2. Any bushland vegetation irrespective of size.
    3. Any tree or plant, irrespective of size, listed in a register of significant or heritage trees adopted by Council at any time.
    4. Any pruning of roots greater than 50mm diameter. required where:
      (a) The tree is “Dead”; (Ensure the tree is not leafless because it is a deciduous tree)
      (b) The tree is “Dangerous”, posing an imminent danger to property or life.

    Warringah Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. Any tree which is dead.
    2. The tree is declared by a qualified arborist to be an imminent danger to property or life.
    3. Any tree with a height less than five metres and with a foliage crown spread of less than ten metres.
    4. Pruning of tree branches and foliage which cause the reduction of no more than 10% of the air space occupied by the branches and foliage.
    5. Any tree identified for removal in a development consent, but only if removal occurs after the construction certificate has been issued in relation to that land use.

    The Tree Preservation Order exemption list does not apply to the following:

    1. Trees within a State Forest
    2. Trees in a National park
    3. Plants declared to be noxious weeds (see TPO for full details)
    4. Any trees which are part of councils hazard reduction program or required to be removed by the Rural Fire Brigade or to be removed under the Rural Fires Act 1997.
    5. Any tree requiring immediate removal essential for emergency access.
    6. Trees authroised to be removed, trimmed or pruned in accordance with the Environmental planning and Assessment Act 1979.

    Pruning of trees within Warringah Council is allowed where deadwood is being removed from the tree or any species of parasite mistletoe or parasitic plant from any part of a tree is removed.

  • Canada Bay Council

    Canada Bay Council Tree Preservation Order

    Canada Bay Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. The tree was dead or that the works were limited to the removal of dead branches;
    2. The tree is a declared noxious weed in the local government area of the City of Canada Bay under the Noxious Weed Act 1993.
    3. Pruning of limbs to 500mm from domestic service leads as specified by Energy Australia, provided that the works were carried out by a qualified or experienced Arborist or Tree surgeon, in accordance with the Australian Standards for the Pruning of Amenity Trees AS 4373-1996.
    4. Emergency Works- any works carried out by Council, the State Emergency Services, the Rural Fire Service of NSW, or a public authority in response to an emergency;
    5. Works carried out by State and Federal Government departments or Authorities under current legislative requirements; or carried out by Council or its agents.
    6. A fruit tree grown for the purposes of fruit or fodder production except Acmena spp (Lilly Pilly), Syzygium spp (Lilly Pilly) or Elaeocarpus spp (Blueberry Ash).
    7. Cinnamomum camphora (Camphor Laurel) or Liquidamber styraciflua (Liquidambar) where the outside edge of the trunk of such tree is located within 3 metres of any single storey dwelling (not being an out building eg. Garage, carport, shed, etc)

    1. The tree has a height of, or greater than, four (4) metres;
    2. The tree has a trunk girth of, or greater than, 500mm at any point; or
    3. The tree is a cycad or mangrove, irrespective of its dimensions, except with the express written consent of the Council.

    City of Sydney Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. Removal of a dead/dying or dangerous tree
    2. Work carried out on a tree by the Council, State Emergency Services or a person acting on either of their behalf in response to an emergency.
    3. Removal or pruning in accordance with AS4373 Pruning of Amenity Trees to allow electricity supply.
    4. Removal of pruning in accordance with AS4373 Pruning of Amenity Trees to provide 0.5 metre clearance of insulated electricity supply cables.
    5. Tree pruning or removal approved by a current Development Consent issued by the City.
    6. Control, removal and eradication of any species declared a noxious plant within the City under the Noxious Weeds Act, 1993.

    Holroyd City Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. Removal of dead trees
    2. Pruning of dead wood or dead palm fronds and vegetation overhanging pedestrian walkways to a height of 2.4m above the walkway.
    3. Pruning work specifically for the purpose of improving a tree’s health. See full TPO for details.
    4. Thinning of a tree’s canopy, removing a specific overhanging branch and reducing a tree’s vigour, spread, or its height, all which are required to meet the Australian Standard AS4373 Pruning of Amenity Trees.

    4. Actions causing damage to the tree’s trunk, including drilling or boring, other than for the purpose of pest treatment or hazard assessment by a qualified professional

    Hornsby Shire Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. Remove a tree less than three metres in height
    2. Remove a dead tree
    3. Remove a tree within three metres of the foundation walls of an approved building or in-ground pool
    4. Remove a declared noxious weed
    5. Prune a tree according to AS 4373 (Australian Standard – Pruning Amenity Trees) by less than 10% of the foliage area within a period of not less than twelve (12) months since any prior pruning (see “pruning trees”)
    6. Remove any tree harbouring fruit fly or grown for its edible fruit

    Exempt tree species within Hornsby Shire Council are as follows:

    The Tree Preservation Order exemption list does not apply to the following:

    1. Any tree greater than three metres in height.
    2. Pruning of a tree by greater than 10 percent of the foliage area.
    3. Substantially altering the soil level around the trunk or within three metres of the trunk of a tree.
    4. Removing any trees not otherwise listed in the exempt species table (provided any tree/trees of these species are not identified as a Heritage item within Hornsby Shire).
    5. Removing a palm tree.
    6. Tree listed on the STR (Significant Tree Register)

    Council may consider granting consent to remove a tree where:

    1. A tree is considered by Council to be dying, dangerous or diseased.
    2. A tree is causing or likely to cause substantial property damage to houses, buildings, etc.
    3. A tree is substantially misshapen or causing substantial over-shadowing.

    Ku-ring-gai Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. Removal of completely dead trees and dead branches.
    2. Removal of tree branches which directly overhanging roof of a residents or commercial building may be pruned back to nearest branch junction or collar to clear the roofline.
    3. Trees within 3.0 metres of an existing dwelling, measured from centre of trunk at ground level to external walls of building. The trunk of the tree has to be located on same property. (see TPO for conditions)
    4. Branches and trees within 0.5 metres of these lines. (exemption applies to tree branches not trunks).
    5. Tree works undertaken by Council or Council’s authorised agents on Council owned land.
    6. Trees approved for removal under development consents once the Construction Certificate has been released.
    7. Pruning of trees where:
      • Branches pruned are not more than 50mm in diameter
      • Roots pruned are not more than 30mm in diameter
      • Pruning is consistent with the Australian Standard for Pruning of Amenity Trees (AS 4373-2007)

    Lane Cove Council Tree Preservation Order

    Lane Cove Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. All trees less than 4 metres in height and a trunk diameter less than 150mm
    2. Pruning of dead branches
    3. Pruning of branches that are within 2 metres of electric powerlines
    4. Pruning and removal of fruit trees and flowering fruit trees (Prunus sp, Malus sp, Citrus sp)
    5. Pruning and reshaping of Cypress Pines not greater than 10% of whole canopy
    6. Pruning and removal of Crepe Myrtle with a height less than 6m.
    7. Tree species that have been declared a noxious plant for the Lane Cove Municipality under the Noxious Weeds Act 1993

    Exempt tree species within Lane Cove Council are as follows:

    The Tree Preservation Order exemption list does not apply to the following:

    1. Any tree, whether indigenous, or exotic which has
      i) a height exceeding 4 metres, and
      ii) a trunk diameter greater than 150mm (measured at 1 metre above the ground).
    2. Trees in bushland which are not subject to an approved plan of management.

    This Tree Preservation Order prohibits the ringbarking, cutting down, topping, lopping, removing, injuring or wilful destruction of any tree within the local government area of Lane Cove having a height greater than 4 metres and a diameter greater than 150 millimetres (measured at 1 metre above the ground) excepting where the consent of Council is first obtained.

    Mosman Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. Prune or remove a tree or shrub less than 5 metres in height (or in the case of heritage conservation areas, less than 2 metres in height); or which has a circumference of less than 450 millimetres measured 300 millimetres above ground level.
    2. Remove dead trees or dead wood from trees
    3. Prune or remove a tree that has been declared a noxious plant under the Noxious Weeds Act 1993.
    4. Remove a tree that poses an imminent hazard to a person or property and there has been visual and written evidence recorded by a qualified professional arborist which justifies the action taken.
    5. Prune or remove any tree that is harbouring fruit fly as confirmed and recorded in writing by a suitably qualified professional.

    Parramatta City Councils Tree Preservation Order allows for the following work to be carried out without consent or permission:

    1. Removal of a tree which is dead or the removal of dead branches;
    2. Removal of a species that has been declared a noxious plant under the Noxious Weeds Act 1993;
    3. Removal of a species referred to in the Order’s List of Unsuitable Trees (listed below);
    4. Removal of a species Populus spp. – Poplar, Salix spp. – Willow, Cinnamomum camphora – Camphor Laurel and Liquidambar styraciflua of such tree is located within 5 metres of any sewer, single storey dwelling or commercial building (not being an out building)* (*see TPO for specifications)
    5. Removal of a fruit tree or tree grown for the purpose of fruit or fodder production except Acmena spp. – Lilly Pilly, Syzygium spp. – Lilly Pilly and Elaeocarpus spp. – Blueberry Ash;
    6. Any tree on public land as defined as ‘Bushland’ by State Environmental Planning Policy No 19 (see TPO for specifications)
    7. Any species of mistletoe or parasitic plant being removed from any part of a tree to ameliorate the affects upon the tree of such a parasite.

    Council MAY consider granting consent to remove a tree where:

    1. A tree is diseased or dying,
    2. A tree is causing, or is likely to cause substantial property damage (to houses building etc).
    3. A tree is significantly misshapen or causing substantial overshadowing.

    Ryde City Councils Tree Preservation Order allows for the following work to be carried out without consent or permission: (However, Council must be notified, in writing, a minimum of 7 working days prior to the proposed commencement of works. A “Notice of Intent” form is available, from Council’s Customer service locations including the Internet site, for this advice to Council. Works should not commence until receipt of the written permit from Council).Trees that are within 3m of an approved detached building and any associated building, as measured from the outside of the tree, at 1.4m from the ground.

    1. The removal of dead or dying tree/s, as long as the trees are not a threatened species habitat.
    2. Tree(s) posing an immediate danger, e.g. after a storm.
    3. Tree(s) that have been declared noxious weeds in the local government area of the City of Ryde under the Noxious Weeds Act 1993 or an undesirable species
    4. Tree(s) that require pruning in accordance with the Electricity Supply Act 1995 and
    5. the Electricity Supply (General) Regulation 2001.
